入れ墨は芸術なのか?


医師免許がないのに入れ墨(タトゥー)の施術をしたとして、医師法違反罪に問われた大阪府吹田市の彫師増田太輝被告(29)の初公判が26日、大阪地裁(小倉哲浩裁判長)であった。

同被告は「犯罪とされることは納得できない。タトゥーはアートだと信じている」と述べ、無罪を主張した。
弁護団によると、タトゥーをめぐり医師法違反罪で正式な公判が開かれたのは初めて。増田被告は2015年9月、罰金30万円の略式命令を受けたが従わず、裁判を申し立てていた。
検察側は冒頭陳述で、針を皮膚に突き刺して色素を沈着させる行為は、細菌に感染したり血管を傷つけたりする危険がある医療行為だと指摘。同様に針で眉などに色素を入れるアートメークで苦情が寄せられていると述べた。
弁護団は「タトゥーは危険ではなく、医療行為ではない」と反論。彫師に医師免許を要求することは、憲法で保障された表現の自由や職業選択の自由、タトゥーを入れたい人の自己決定権を侵害すると主張した。 


◆入れ墨調査「適法」確定
大阪市が行った入れ墨の有無を確認する調査を拒否し、懲戒処分を受けた職員2人が処分の取り消しを求めた訴訟で、最高裁第2小法廷(小貫芳信裁判長)は9日付の決定で職員側の上告を退けた。取り消しを認めない二審判決が確定した。

大阪市は2012年、市職員の入れ墨が社会問題化しているとして、全職員を対象に調査を実施。拒否した2人は職務命令違反で戒告とされ、「プライバシーの侵害で憲法に違反する」として提訴した。
